Description
The Contract mainly comprises design and construction of the following:
- widening of two sections of Hiram's Highway of approximately 3.5 kilometres (km) in total length between Marina Cove and Pak Sha Wan, and between Pak Sha Wan and Sai Kung Town from the existing single two-lane carriageway to a dual two-lane carriageway;
- widening of the Pak Sha Wan section of Hiram's Highway of approximately 100 metres (m) in length from the existing single two-lane carriageway to a single four-lane carriageway;
- widening of a section of Po Tung Road of approximately 400 m in length between Yau Ma Po Street and Fuk Man Road from the existing single two-lane carriageway to a dual two-lane carriageway;
- improvement of a section of Po Tung Road and Tai Mong Tsai Road of approximately 600m in total length between Fuk Man Road and Wai Man Road to a single two-lane carriageway in accordance with current standards;
- a subway across Hiram's Highway with associated lifts in Pak Sha Wan; and
- ancillary works including drainage and sewerage, waterworks, slope stabilisation, public lighting, noise barriers, landscaping works as well as other associated works.
The works are scheduled to commence in the second quarter of 2024 and will take about 84 months to complete.
Submission of Tenders
Sealed tenders, in duplicate, must be clearly marked with the tender reference and the subject of the tender on the outside of the envelope (but should not bear any indication which may relate the tender to the tenderer) addressed to the Chairman, Central Tender Board, and placed in the Government Secretariat Tender Box located at the lobby of the Public Entrance on the Ground Floor, East Wing, Central Government Offices, 2 Tim Mei Avenue, Tamar, Hong Kong. Tenders must be deposited in the tender box as specified in this tender notice ("Specified Tender Box") before the tender closing time. Late tenders and tenders not deposited in the Specified Tender Box will not be accepted.
If tropical cyclone signal No. 8 or above is hoisted, or a black rainstorm warning signal or "extreme conditions after super typhoons" announced by the Government is/are in force at any time between 9:00 a.m. and 12:00 noon on the tender closing date, the tender closing time will be postponed to 12:00 noon on the first working day after the tropical cyclone signal No. 8 is lowered, or the black rainstorm warning signal or the "extreme conditions after super typhoons" announced by the Government has/have ceased to be in force. In case of blockage of the public access to the location of the Specified Tender Box at any time between 9:00 a.m. and 12:00 noon on the tender closing date, the Government will announce extension of the tender closing time until further notice. Following removal of the blockage, the Government will announce the extended tender closing time as soon as practicable. This tender is covered by the Agreement on Government Procurement of the World Trade Organization and will not involve electronic auction.
Selective tendering is adopted. Confirmed contractors on the List of Approved Contractors for Public Works in Group C under the Roads and Drainage Category or joint ventures with participation of local and/or overseas contractors with at least one of the participants or shareholders being a confirmed contractor on the List of Approved Contractors for Public Works in Group C under the Roads and Drainage Category, who also meet the following qualifications and other conditions for participation stipulated in the tender documents are invited to tender:
- The tenderer has completed at least one (1) relevant construction contract involving roads and drainage works with an adjusted contract sum of not less than HK$900 million, in or outside Hong Kong, within the past five (5) years counting from but excluding the original date set for the close of tender. The adjusted contract sum shall be the awarded contract sum being adjusted to current price level as stipulated in the tender documents.

In case of a joint venture tenderer, the requirement in either paragraph (1) or (2) below has to be satisfied:
- the lead participant or major shareholder is a confirmed Group C contractor included in the List of Approved Contractors for Public Works under the Roads and Drainage Category; OR
- the lead participant or major shareholder is a contractor who is not enlisted in any service category under the List of Approved Contractors for Public Works and the List of Approved Suppliers of Materials and Specialist Contractors for Public Works. In this case,
- the total percentage participation of participant(s) or shareholder(s) who is/are confirmed Group C contractor(s) included in the List of Approved Contractors for Public Works under the Roads and Drainage Category is at least 40%;
- the percentage participation of the lead participant or major shareholder is no more than 60%; and
- the lead participant or major shareholder has completed at least two (2) roads and drainage contracts as the main contractor in or outside Hong Kong SAR, each with a value equal to or greater than the limit on the values of the contract or works that may be undertaken by Group C (probationary) contractors in the Roads and Drainage category of the List of Approved Contractors for Public Works as set out in the Contractor Management Handbook, in the past seven (7) years counting from the original date set for the close of tender.
The detailed requirements for joint ventures with participation of local and/or overseas contractors, if applicable, are stipulated in the tender documents.
Contractors not yet on the List of Approved Contractors for Public Works in Group C (confirmed) under the Roads and Drainage Category may also submit a tender if they submit a request for participation together with a duly completed application for inclusion in the above-mentioned approved list/category by 25 October 2023 to Chief Engineer 5 / Major Works, Major Works Project Management Office, Highways Department, at 3rd Floor, Ho Man Tin Government Offices, 88 Chung Hau Street, Ho Man Tin, Kowloon, Hong Kong, meet the qualifications and conditions for participation, and the application for inclusion is duly approved on or before the tender closing date. Contractors will be liable to have their names removed from the approved list if they fail or refuse to implement an accepted tender.

A charge will be levied for the delivery of tender documents where the delivery of tender documents is requested by a tenderer. A written request must be made.
The Government of the Hong Kong Special Administrative Region does not bind itself to accept any tender irrespective of whether the tender is the lowest bid or where the assessment of tenders is based on a marking scheme or formula approach, the tender with the highest overall score.
The Government of the Hong Kong Special Administrative Region reserves the right to negotiate with any tenderer about the terms of the offer.
